Welcome to ShroomCast. By using our mobile application and services, you agree to these Conditions d’utilisation (« Terms »). Please read them carefully.

1. Acceptation des conditions

By downloading, installing, or using ShroomCast (« the App »), you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms apply to all users, whether free or premium subscribers.

2. Description du service

ShroomCast is a mushroom forecasting platform that uses environmental data, weather conditions, and machine learning models to predict when and where mushrooms are likely to grow.

What ShroomCast provides:

  • Mushroom growth forecasts based on weather, soil, and seasonal data
  • Species-level predictions for edible mushroom varieties
  • Regional maps and forecasts for the UK, Ireland, and other supported regions
  • Premium features including access to all species and advanced forecasting tools

What ShroomCast is NOT:

  • A guarantee that mushrooms will be present
  • Professional mycology or foraging advice
  • A replacement for proper mushroom identification knowledge
  • Responsible for your safety while foraging

3. Responsabilités de l’utilisateur

3.1 Âge requis

You must be at least 13 years old to use ShroomCast. Users under 18 should use the App with parental supervision.

YOU ARE SOLELY RESPONSIBLE FOR:

  • Correctly identifying mushrooms before consumption
  • Understanding which mushrooms are edible and safe
  • Following local foraging laws and regulations
  • Respecting private property and protected areas
  • Your personal safety while foraging outdoors

ShroomCast is a forecasting tool, not a mushroom identification guide. Never eat any mushroom unless you are 100% certain of its identity. Improper identification can result in serious illness or death.

3.3 Activités interdites

You agree NOT to:

  • Use the App for illegal purposes
  • Attempt to reverse-engineer, hack, or exploit the App
  • Share your premium subscription with others
  • Scrape, copy, or redistribute our data or forecasts
  • Impersonate others or create fake accounts
  • Use the App to harm others or violate their rights

4. Abonnement et paiements

4.1 Accès gratuit vs Premium

  • Free users have access to a limited selection of mushroom species
  • Premium users unlock all species, confirmed observation data, and advanced features

4.2 Formules d’abonnement

Premium subscriptions are available through the Apple App Store:

  • Monthly: Billed every month
  • Quarterly: Billed every 3 months (save compared to monthly)
  • Annual: Billed every 12 months (best value)

All subscriptions auto-renew unless canceled at least 24 hours before the renewal date.

4.3 Traitement des paiements

All payments are processed by Apple Inc. through the App Store. We do not store your payment information.

Prices are displayed in your local currency and may vary by region due to taxes and exchange rates.

4.4 Renouvellement automatique

Subscriptions automatically renew at the end of each billing period. You can cancel anytime in your Apple App Store settings:

  1. Open Settings → [Your Name] → Subscriptions
  2. Select ShroomCast
  3. Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain premium access until expiration.

4.5 Remboursements

Refund requests are handled by Apple Inc. according to their refund policy.

We cannot process refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.

4.6 Modifications des prix

We may change subscription prices at any time. If your subscription price increases, we will notify you at least 30 days in advance. The new price will apply to your next renewal unless you cancel.

5. Précision et limites

ShroomCast forecasts are predictions based on data models, not guarantees. Actual mushroom growth depends on many factors, including:

  • Microclimates and local variations
  • Soil composition and moisture
  • Forest health and human activity
  • Natural variability and chance

We do not guarantee that mushrooms will be present in predicted locations.

5.2 Sans garantie

THE APP IS PROVIDED « AS IS » WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:

  • Accuracy of forecasts
  • Uninterrupted service availability
  • Error-free operation
  • Fitness for any particular purpose

6. Limitation de responsabilité

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

  • Injuries, illnesses, or deaths resulting from foraging
  • Mushroom misidentification or consumption
  • Inaccurate forecasts or predictions
  • Lost data, profits, or opportunities
  • Indirect, incidental, or consequential damages

YOU USE THE APP AT YOUR OWN RISK.

If you consume a mushroom that causes harm, it is your responsibility, not ours. Always consult a professional mycologist or mushroom identification expert before consuming wild mushrooms.

7. Propriété intellectuelle

7.1 Propriété

All content, designs, logos, forecasting models, and software code in ShroomCast are owned by ShroomCast or its licensors. You do NOT acquire any ownership rights by using the App.

7.2 Licence d’utilisation

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute the App
  • Sell or sublicense access to the App
  • Use our data for commercial purposes without permission

8. Confidentialité et collecte de données

Your use of ShroomCast is also governed by our Privacy Policy. By using the App, you consent to our data collection practices as described in the Privacy Policy.

Key points:

  • We collect Device ID and subscription data
  • We use temporary location data (not stored)
  • We do NOT collect email addresses or personal identity
  • You can delete your account and data anytime

9. Résiliation

9.1 Votre droit de résilier

You may stop using the App at any time by simply uninstalling it. To request permanent deletion of your data, contact us at contact@shroomcast.net with details about your subscription status (if applicable), and we will locate and delete your account data.

9.2 Notre droit de résilier

We may suspend or terminate your access to the App if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the service or harm other users

Termination does not entitle you to a refund for unused subscription time.

10. Modifications des conditions

We may update these Terms from time to time. We will notify you of significant changes by:

  • Updating the « Last Updated » date at the top
  • Displaying an in-app notification for material changes

Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Droit applicable

These Terms are governed by the laws of Republic of Ireland, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Ireland.
